North Carolina General Statute 95-129 (1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish to each of his employees conditions of employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees: a)in that at the time of the incident on Jan. 30, 1998 employees were working from an elevated platform in an area where an overhead crane was subject to be operated in close proximity of the elevated platform and appropriate procedures had not been taken to assure that the overhead crane and/or other moving equipment would not be operated in the area in which the employees were working. Among other methods one feasible method to correct the hazard is to establish specific written procedures to prevent any moving equipment from being operated in an area where employees will be working from an elevated platform.
