Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not furnish employment and a place of employment which were
free from recognized hazards that were causing or likely to cause death
or serious physical harm to employees in that:
a) Employees working in the Service Department were exposed to the
hazards of being struck by and/or crushed while working on vehicles
elevated by defective vehicle hydraulic lifts, as set forth below:
1) In the third (3rd) bay, from the west end of the building, a vehicle
was elevator and the safety pin was not in place to prevent movement
in case of hydraulic pressure failure.
2) In the second (2nd) bay, from the west end of the building, a vehicle
was elevated and there was no effective safety device to prevent
movement in case of hydraulic pressure failure.
The hazard can be abated by a program including but, not limited to:
1) Provide and/or install operable safety devices on the lift post of
the car lift.
2) Assure that persons operating the lifts are throughly trained in its
use, in the method of handling the controls, in the use of each
safety device and in the safety procedures to be followed.
