Minn. Stat. 182.653 subd. 2:  The employer did not furnish to each
employee, conditions of employment and a place of employment free
from recognized hazards which caused or were likely to cause death
or serious injury to employees; specifically
The employer permitted the use of a rough terrain forklift
with the following apparent deficiencies:
A. The backup alarm was not maintained in a working
condition exposing employees to crushing hazards; and
B. The factory installed seatbelt was missing exposing
employees to crushing injuries in the event of machine
overturn; and
C.  A piece of lumber was wedged between the instrument panel
and the brake pedal in order to replace the function of
the factory installed parking brake mechanism which had
been removed exposing employees to crushing hazards in
the event of unintended machine movement when parked on
an incline.
