Minn. Stat. 182.653 subd. 2:  The employer did not furnish to each
employee, conditions of employment and a place of employment free
from recognized hazards which caused or were likely to cause death
or serious injury to employees:
A. The employer did not instruct each dispatcher and the
administrative assistant in the recognition and avoidance
of unsafe conditions and the regulations applicable to
the employee's work environment to control or eliminate
any hazards or other exposure to illness or injury while
performing the work of a jailer.
B. The employer exposed the Sheriff's office employees to
the risk of death or serious physical harm by not
providing a safe and secure work place free from
recognized hazards.  Employees were expected to perform
their job duties in close proximity to aggressive,
violent, intoxicated and disturbed detainees who were
sometimes unrestrained, and who routinely subjected the
employees to abusive and threatening behavior, and at
times violent acts.
ABATEMENT GUIDELINES:
A.  The employer shall provide training to dispatchers and the
administrative assistant who are exposed to hazards related to
working with and around detainees on techniques including but not
limited to:  de-escalation, transport, self defense, use of
restraints, hostage survival, pat downs, and weapons searches,
managing hostile and manipulative people and other techniques that
will give the employees skills necessary to perform their jobs.
B.  The employer shall submit a written proposal on how a safe,
secure, adequate facility will be provided for employees exposed to
violent detainees.  The proposal shall list and detail a corrective
course of action with corresponding dates or time frames for the
completion of a safe, secure, adequate facility.
