Stat. 182.653 subd. 2: The employer did not furnish to each employee, conditions of employment and a place of employment free from recognized hazards which caused or were likely to cause death or serious injury to employees; specifically: On May 4, 1999, employees were exposed to fall hazards in excess of 15 feet while working from a personnel basket attached to the forks of a rough terrain forklift telescoped out to approximately 25 feet. The basket was not equipped with an adequate guard rail system. Employees were not wearing any personal fall arrest equipment.

Minn. Stat. 182.653 subd. 2: The employer did not furnish to each employee, conditions of employment and a place of employment free from recognized hazards which caused or were likely to cause death or serious injury to employees; specifically: On May 4,1999 employees were exposed to injuries caused by crushing hazards when a Lull Highlander forklift was used to elevate them in a personnel platform when: 1) the combined weight of the platform, load, and personnel exceeded one-third the capacity as indicated on the load chart of the rough terrain forklift; 2) no information regarding maximum load, empty platform weight, or minimum capacity of the forklift used was posted on the platform; 3) the personnel platform was not adequately secured to the lifting carriage of the forklift in a manner so as to prevent the forks from rotating upwards; and 4) the width of the platform exceeded recommended guidelines.
