Stat. 182.653 subd. 2: The employer did not furnish to each employee, conditions of employment and a place of employment free from recognized hazards which caused or were likely to cause death or serious injury to employees; The following refers to the Skyjack self-propelled elevating work platform, model 3219, serial #23488, that was operated on 11-30-99: a)A Prestart inspection had not been performed as required by ANSI A92.6-1990, sec. 8.3. b)Any problems or malfunctions that affect the safety of operations(missing end rails) had not been repaired prior to the use of the aerial platform as required by ANSI A92.6-1990. sec. 8.4.
