furnish employment and a place of employment which was free from
recognized hazards that were causing or likely to cause death or
serious physical harm to employees in that employees were exposed
to:
(a) At this site (110 Industrial Dr, Lynchburg, VA), BMG Metals
failed to ensure that powered industrial truck operators wore seat
belts when operating vehicles equipped with seat belts.
"One feasible and acceptable abatement method, among others, to
correct this hazard is to require employees to wear seat belts when
the powered industrial truck is equipped with them (see national
consensus standard ASME B56.1-1993)."
