Title 40.1-51.1.(a), Code of Virginia: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that: (a) At this worksite (Brookville Chevron, 8217 Timberlake Rd, Lynchburg, VA), RPM Installations, Inc. failed to ensure that the employee on the scaffold platform, installed on the truck, was protected from fall hazards while the truck was being moved. There were no guardrails in place, exposing the employee to a fall of approximately 12 feet to a paved surface. "One feasible and acceptable abatement method, among others, to correct this hazard is to not allow employees to be on scaffold platform while the vehicle is in motion."
