A.R.S. 23-403.A.: The employer did not furnish to each of his employees employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to his employees in that four (4) employee(s) were being transported in a motor vehicle in such a fashion that they were exposed to the risk of falling from the moving vehicle due to the lack of seats adequate for the number of employees being transported, and the practice of transporting employees on the bumper of moving motor vehicles, (i.e., pickup truck, 1986 Chevrolet full size industrial truck, license number 4NN 117). a) 3420 South 48th Street, Phoenix, AZ 85040: Four (4) employees were being transported in a motor vehicle, in such a manor that they were standing on the rear bumper of a moving vehicle and were not protected from falling off the vehicle by a seat and/or seatbelt protection.
