A.R.S. 23-403.A.: The employer did not furnish to each of his employees employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to his employees in that the employer did not adequately instruct each employee required to maintain and service, and each employee required to conduct pre-operation inspections of an aerial devised platform (aerial lift) in accordance with; (1) the manufacturer's recommendations, (2) the American National Standards Institute (ANSI A92.2-1969, 1979, and 1990) vehicle-mounted elevating and rotating work platforms, and (3) ANSI Z133.1-1972, 1982, and 1994 Tree Care Operations: (a) 2441 South 22nd Avenue, Phoenix, AZ 85009: The employer did not provide adequate training to each employee required to maintain and service a Reach All aerial platform (Model AP75MH, Serial #8541) in accordance with the American National Standards Institute (ANSI A92.2-1990), in that employee(s) required to maintain and service this aerial platform were not "qualified" as defined by the American National Standards Institute. (b) 2441 South 22nd Avenue, Phoenix, AZ 85009: The employer did not maintain a checklist with the aerial device which contains the minimum manufacturer's required checkpoints for the pre-operation inspection (i.e., Frequent Inspection) of a Reach All aerial platform (Model AP75MH, Serial #8541) in accordance with the following; (1) the manufacturer's recommended instructions and procedures in the operators and maintenance manual (See Tabs AA), and (2) ANSI Z133.1-1972, 1982, and 1994 (See Tab BB).

A.R.S. 23-403.A.: The employer did not furnish to each of his employees employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to his employees in that the employer did not service an aerial devised platform (aerial lift) in accordance with; (1) the manufacturer's recommendations, and (2) the American National Standards Institute (ANSI A92.2-1969,1979, and 1990) vehicle- mounted elevating and rotating work platforms: (a) 2441 South 22nd Avenue, Phoenix, AZ 85009: The employer did not regularly service a Reach All aerial platform (Model AP75MH, Serial #8541) based on the established regular service intervals in accordance with the following; (1) the manufacturer's recommended instructions and procedures in the maintenance manual (Sections 3.1.2 and 3.2), (See Tab CC), and (2) the American National Standards Institute (ANSI A92.2-1969, 1979, and 1990), (See Tab DD). (b) 2441 South 22nd Avenue, Phoenix, AZ 85009: Preventive maintenance was not performed on a Reach All aerial platform (Model AP75MH, Serial #8541) in accordance with the City of Phoenix's history card, in that the Component section which addresses the aerial unit was not completed on the last date of service.
