T.C.A. 50-3-105(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were likely to cause death or serious physical harm to an employee, in that an employee was exposed to the hazard of a falling (approximately 300 lb) mold when working underneath it, while the mold was suspended above him by hanging it from straps attached to the forks of a forklift truck. Such a hazard was readily recognizable and could cause serious physical harm to the employee. The C&C Machine Operator, on 11/18/04, was wiping the bottom of the mold before it was set on the machine table so that it would make good contact to the table. Among other methods, one feasible and acceptable abatement method to correct this hazard is to wipe the bottom of the mold off at the time the mold is received and when the bottom protective plate is removed, while the mold is setting (on its top) on another table - not suspended in the air. Note: the company representative stated on 1/10/04 the above abatement had been applied, and the molds were no longer wiped while suspended above an employee.
