Minn. Stat. 182.653 subd. 2:  The employer did not furnish to each
employee, conditions of employment and a place of employment free
from recognized hazards which caused or were likely to cause death
or serious injury to employees:
Employer did not develop and implement a tuberculosis Mantoux
screening program in accordance with guidelines established by
the Centers for Disease Control, specifically:
a) two-step Mantoux skin testing was not conducted for the
initial screening of employees who have not been tested in the
preceding 12 months;
b) employees were allowed to self-report Mantoux skin test
results;
c) a risk assessment was not conducted to evaluate the risk of
transmission of tuberculosis in the facility and a Mantoux
screening program was not developed based on the evaluation.
