Minn. Stat. 182.653 subd. 2: The employer did not furnish to each employee, conditions of employment and a place of employment free from recognized hazards which caused or were likely to cause death or serious injury or harm to its employees: The employer failed to provide sufficient security measures and failed to effectively implement security measures at its workplace to protect its employees from exposure to violent acts which cause or are likely to cause serious injury or death. (Violent acts may include but are not limited to abduction, robbery, assault and homicide.) The employer's security measures were ineffective in that: (a)The employer failed to provide sufficient security measures to protect employees, including security measures that would deter violent acts and security measures that would mitigate the consequences of violent acts once they commence. (b)The employer instituted work policies or expectations that reduced or eliminated the effectiveness of existing security measures. Abatement Guidelines: 1)The employer shall obtain a written crime and security evaluation of the employer's workplace that focuses on employee safety and is conducted by a crime prevention practitioner familiar with convenience store operations. The employer shall implement the evalutation's recommendations regarding employee safety. As part of the crime and security evaluation, the practioner shall evaluate and make recommendations regarding the implementation of the following abatement measures: a)Two or more employees working during operational hours considered to be late night (operations after 11:00 PM). b)Installation of a barrier which protects the employee from violent acts including, but not limited to, instances of abduction, robbery, homicide and assault. c)Security guard. d)A reduction of operating hours to establish closing of the convenience store prior to or at 11:00 PM. e)In/out window service only with all doors secured at 11:00 PM. f)Assessment of access to parking lots/personal vehicles for additional security needs. g)Installation of a remote panic alarm system, commonly referred to as remote pendants. h)Installation of a surveillance camera system, which will effectively identify the patrons of the convenience store and effectively assist in the identification of individuals engaged in criminal activity, with adherence to all manufacturer's guidelines. i)Installation of a surveillance camera system which will identify the license plate of automobiles utilizing the business's premises, with adherence to all manufacturer's guidelines. j)Installation of surveillance cameras within the interior and exterior of the business which photographically cover those areas not visible to employees while working from the store's service counter. k)Installation of exterior and interior lighting that will effectively eliminate inside/outside glare and provide "bright" lighting at all locations utilized by employees. l)Installation of height tape at the entry and exit doors of the business. m)Installation of door sensors with strict adherence to manufacturer's guidelines. 2)The employer shall eliminate workplace policies that conflict with the proper and effective use of existing or future security measures.

Stat. 182.653 subd. 2: The employer did not furnish to each employee, conditions of employment and a place of employment free from recognized hazards which caused or were likely to cause death or serious injury to employees: The employer failed to train some of its employees and failed to adequately train other of its employees on the proper use of existing employee safety and security measures at its workplace to protect its employees from exposure to violent acts which cause or are likely to cause serious injury or death. (Violent acts include but are not limited to abduction, robbery, assault and homicide.) Abatement Guidelines: 1)Train all current and future employees on existing safety and security measures including how those safety and security measures operate and their operational expectations. 2)Train all current and future employees on the results and recommendations brought forth as a result of a crime prevention practitioner's written evaluation. 3)Train all current and future employees on the hazards associated with convenience store operations pertaining to violent acts including, but not limited to, abduction, robbery, homicide and assault perpetrated against convenience store employees and preventative methods used to control those hazards. 4)In addition, the employer should train all current and future employees on the proper use of any additional safety and security measures it adopts in the future; including non-violent conflict resolution, the basis for the identification of potential perpetrators, basic self defense tactics, and any further training to enhance employee safety (e.g. law enforcement, security systems representatives, crime prevention practitioners, employee assistance programs).
