MN Stat. 182.653, subd. 2: The employer did not furnish to each employee, conditions of employment and a place of employment free from recognized hazards which caused or were likely to cause death or serious injury to employees, specifically: Employee was operating a Clark forklift with rollover protection, but the unit did not have required seat belts to protect the employee from crushing injury. This unit was operating inside and outside of the facility over uneven ground moving drums and pallets.
