Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that: a) On or about December 30, 1985, and at times prior thereto, employees were exposed to the hazard of asphyxiation while repairing impellar seals inside mash tanks. One feasible means of abatement, among others, is training of employees in safe confined space entry procedures, isolating the tank from carbon dioxide vent lines by blanking or disconnecting and ventilation of the tank to remove air contaminants below hazardous levels.
