Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not furnish employment and a place of employment which were
free from recognized hazards that were causing or likely to cause death
or serious physical harm to employees in that:
a) Employees(s) were subject to hazard of falling, being struck by,
being caught in, crushing, amputations, and death while working with
and around the Page locomotive #115 and flat car #205.
Abatement of the hazard can be accomplished by the establishment of
management controls over the work being performed, instructions of
workers in the recognition of hazards, documentation of maintenance
performed.
Elements of the abatement program shall include, but not be limited to:
1) Secure and maintain current operations and maintenance manuals on
all railway equipment.
2) Analyze the railway equipment and determine hazards that are present.
Establish and document the procedures which will be used in
performing inspection and maintenance of the equipment.
3) Establish and use a documented work order system for inspection,
maintenance and repair. Document the repairs made.
4) The employer shall develop a training program for the affected
equipment operators.
5) The training shall be repeated as frequently as is necessary to
maintain proficiency and compliance with the procedures.
6) Only trained employees shall operate the railway equipment.
7) Determine, post, and enforce the load capacity for the flat car.
8) Following repairs shall be made on the locomotive:
a) Bent and damaged sill steps shall be repaired or replaced.
b) Bent and damaged grab irons shall be repaired or replaced.
c) Bent foot boards shall be repaired.
d) Badly damaged and dislodged left fender shall be repaired or
replaced.
9) Following repair shall be made on the flat car:
All 8 steps that are bent, broken or displaced shall be repaired or
replaced.

Among other methods, one feasible and acceptable abatement method to
correct this hazard is:
Installing spill guards fo sufficient strength and capacity to catch,
retain and contain any foreseeable spillage which might cause
personal injury from the conveyor.
