Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard(s) of toxic chemical inhalation and/or chemical burns from an uncontrolled spill of sulfuric acid: Employees who worked in the immediate vicinity of the chlorine compression 306 area of the Kemira, Inc. chloride plant were exposed to the hazards of toxic chemical inhalation and chemical burns while they were trying to assist and acid-burned worker from a spill of approximately 800 gallons of 95% sulfuric acid that was released onto the ground from a defective valve assembly on the H compressor, emptying a surge tank that supplies acid to this and seven (7) other similar compressors used as a cleaner and seal lubricant, on or about 6/3/90.
