Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard(s) of toxic chemical inhalation from an uncontrolled release of titanium tetrachloride: Employees were exposed to the hazards of toxic chemical inhalation and chemical burns due to the uncontrolled release of titanium tetrachloride. Monitoring and safety hazard warning systems were not functioning, thus causing thr operator of the Chlorination B Purification Still at Kemira, Incorporated, on 01/03/90, to be unaware of upset conditions that led to the release of approximately 5,000 pounds of titanium tetrachloride.
