Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to a fall hazard when boarding or leaving tugboats. there was no ramp, safe walkway or other safe means of access provided: a) Employees were permitted to baord the tugboat "Donald G. McCallister" by stepping or jumping down to the port side of the tugboat from the dock. The port side of the tugboat at one point during the day, due to low tide, was approximately 45 inches below the dock. b) The employees were permitted to board the tugboat "Francis K. McCallister" by stepping or jumping down to the port side of the tugboat from the dock. The port side of the tugboat at one point during the day, due to low tide, was approximately 45 inches below the dock. c) The employees were permitted to board or leave the tugboat "Charles D. McCallister" by jumping or stepping from the side of the tugboat it was tied to. In addition to the fall hazard, the employees were potentially exposed to falling into the water and being crushed between the two tugboats. d) The employees were permitted to board or leave the tugboat "Wilmington" by jumping or stepping from the side of the tugboat it was tied to. In addition to the fall hazard, the employees were potentially exposed to falling into the water and being crushed between the two tugboats. e) The employees were permitted to board or leave the tugboat, "Southport" by jumping or stepping from the side of the tugboat it was tied to. In addition to the fall hazard, the employees were potentially exposed to falling into the water and being crushed between the two tugboats. f) The employees were permitted to board or leave the tugboat "William H. McCallister" by jumping or stepping from the side of the tugboat it was tied to. In addition to the fall hazard, the employees were potentially exposed to falling into the water and being crushed between the two tugboats. g) The employees were permitted to board the tugboat "Wyoming" by stepping or jumping down to the starboard side of the tugboat from the dock. The starboard side of the tugboat at one point during the day, due to low tide, was approximately 40 inches below the dock. h) The employees were permitted to board the tugboat "Nebraska" by stepping or jumping down to the starboard side of the tugboat from the dock. The starboard side of the tugboat at one point during the day, due to low tide, was approximately 40 inches below the dock.
