Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The
employer did not furnish employment and a place of employment which were
free from recognized hazards that were causing or likely to cause death
or serious physical harm to employees in that on December 28, 1988 at
the University Dr. and ST RD. 84 site, employees were exposed to the
hazards of tripping and falling into the water while using a wide flange
beam, web up, for a walkway to a cofferdam.
Particular concerns include the following hazards:
a) The walkway was not equipped with a standard railing.
b) The web was strewn with lumber and concrete brick.
c) Employee(s) were required to step from the walkway (beam), over an
open space in a platform in order to reach the ladder that was used
for access to the cofferdam top.
Among other methods one feasible and acceptable method to abate these
hazards is to re-locate the existing guard railed gangway running from
the shore to the cofferdam bottom, directly from the shore to the
cofferdam top. (Reference 1926.605(b)(2))
