Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to sewer lift station construction, Howard Industries, Inc. Employees exposed to hazard(s) of fall of approximately 15 ft. to concrete pipe sand in excavation while riding in buckets of: a) Hitachi Trackhoe Model #UH081. b) Massey Ferguson front end loader/backhoe Model #308. One feasible and acceptable abatement method to correct this hazard does not allow employees to ride in buckets or anywhere on machine(s) if there is no manfacturer's designated place for a rider.
