Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The %% employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: a) A diesel powered bobcat used to clean the bottom of grain barges was suspended above employees working on the barges, by a winch used to raise and lower the bobcat. Two feasible and acceptable means of correcting this hazard would be to lower the bobcat and place it on shore side or reroute employees where they cannot get under the load.
