Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: (a) The employer had not established nor conducted a training program to ensure that the derrick operator and the designated individuals in charge of lifting or unloading operations were knowledgeable of and could demonstrate safe operating pro- cedures of the American Hoisting & Derrick Co. derrick, serial #20860 used to unload sand & gravel and to clean barges at the river facility on the Ohio River.
