Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not furnish employment and a place of employment which were
free from recognized hazards that were causing or likely to cause death
or serious physical harm to employees in that employees were exposed to:
a) East side, mezzanine level, parking garage, Seneca & Elm Streets, Oil
City, PA; employees working from a two point suspension scaffold were
not protected against a fall hazard of approximately 18 ft. due to
the scaffold collapse in that:
1) Counterweights were not securely fastened to the outrigger beams to
prevent unauthorized and/or accidental removal.
2) Counterweights were not identified as to their weight.
3) Counterweights consisted of a flowable material (sand).
4) There were no tiebacks attached to the outrigger beams to serve as
a secondary means of anchorage.
5) There were no latches across the hook throat openings at the outboard
end of the outrigger beams.
One method of abatement, among others, is the installation of tie backs
on the outrigger beams, use of a non-flowable counterweight material,
securing and marking the counterweights, and closing off the hook throat
openings with latches.
