Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to hazardous conditions associated with trenches. %% The accident prevention program did not provide for frequent and regular inspections of the job sites, materials, and equipment to be made by competent persons designated by the employer: (a) Throughout site-A competent person did not make frequent and regular inspections of the work area to identify and correct unsafe work conditions. %% Abatement Note: "Competent person" means one who is capable of identifying existing and predictable hazards in the surroundings or working conditions which are unsanitary, hazardous, or dangerous to employees, and who has authorization to take prompt corrective measures to eliminate them. (a) PIPE LINE EXCAVATION: THERE WAS NO ACCIDENT PREVENTION PROGRAM FOR FREQUENT AND REGULAR INSPECTIONS OF JOB SITE MATERIALS AND EQUIPMENT.
