Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The
employer did not furnish employment and a place of employment which were
free from recognized hazards that were causing or likely to cause death
or serious physical harm to employees in that employees were exposed to:
THE HAZARDS OF HAVING PART OF THEIR BODY CAUGHT BETWEEN THE MOVING
ELEVATOR AND THE HOISTWAY. A FEASIBLE AND USEFUL METHOD TO CORRECT THIS
HAZARD, AMONG OTHER METHODS, IS THE INSTALLATION OF ELEVATOR CAR DOORS
FOR GATES THAT WOULD PREVENT EMPLOYEES FROM HAVING ANY PART OF THEIR
BODY OUTSIDE THE PERIPHERY OF THE ELEVATOR CAR UNLESS THE ELEVATOR CAR
IS WITHIN THE LANDING ZONE AND THAT WERE ELECTRICALLY INTERLOCKED TO
PREVENT THE ELEVATOR CAR FROM MOVING UNLESS THE ELEVATOR CAR DOORS OR
GATES ARE IN THE CLOSED POSITION.
a) MACHINE ROOM, NEAR #1 MACHINE WINDER: ELECTRIC FREIGHT ELEVATOR OF
6,000 LB. CAPACITY WAS NOT PROVIDED WITH A CAR GATE ON THE NORTH
SIDE, THAT WOULD PREVENT EMPLOYEES FROM HAVING ANY PART OF THEIR
BODY OUTSIDE THE ELEVATOR CAR IN THAT THE NORTH SIDE CAR GATE WHEN
CLOSED DID NOT FIT FLUSH WITH THE CAR FLOOR.
b) THE EMPLOYER DID NOT FURNISH EMPLOYMENT AND A PLACE OF EMPLOYMENT
WHICH WERE FREE FROM RECOGNIZED HAZARD THAT WERE CAUSING OR LIKELY TO
CAUSE DEATH OR SERIOUS PHYSICAL HARM TO EMPLOYEES IN THAT EMPLOYEES
WERE EXPOSED TO BEING STRUCK AND/OR CRUSHED BY ROLL(S) OF PAPER, IN
THE AREA BETWEEN THE REEL SECTION AND WINDER SECTION OF PAPER MACHINE
#1 OR IN CLOSE PROXIMITY TO SHEPART NILES HOIST (SERIAL #119327) AND
ITS SUSPENDED LOAD. ON FORWARD TRAVEL OF HOIST, WHEN CONTROL BUTTON
WAS RELEASED, THE UNIT CONTINUED TO COAST. WHEN HOIST UNIT WAS
LOWERED, IT CONTINUED TO COAST DOWN WHEN THE BUTTON WAS RELEASED.
THE BRAKING SYSTEM WAS NOT OPERATING PROPERLY WHEN THE CONTROLS WERE
RELEASED. THE HOIST IS RATED AT 2-TON CAPACITY; DURING THIS
INSPECTION ON 4/23/90, THE WEIGHT OF THE LOAD WHILE TESTING THE HOIST
WAS 1200 LBS. AMONG OTHER METHODS, ONE FEASIBLE AND ACCEPTABLE
ABATEMENT METHOD TO CORRECT THESE HAZARDS IS TO CONDUCT FREQUENT
(DAILY TO MONTHLY) AND PERIODIC (MONTHLY TO ANNUAL) INSPECTIONS OF
THE HOISTING EQUIPMENT TO DETERMINE UNSAFE CONDITIONS SUCH AS
INADEQUATE BRAKING ACTION. ALL DEFICIENCIES NOTED MUST BE RECORDED
AND CORRECTIVE ACTION TAKEN.
