Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: a) BEING STRUCK BY AND FALLING FROM THE WALTCO R6L-SERIES II TAILGATE LIFT, MODEL 375, RATED AT A MAXIMUM LOAD CAPACITY OF 5,000 LBS., DUE TO THE BREAKING OF THE LIFTING CABLE(S) DURING ROUTINE OPERATION. AMONG OTHER METHODS, ONE FEASIBLE AND ACCEPTABLE ABATEMENT METHOD TO CORRECT THE HAZARD IS TO CONDUCT ROUTINE INSPECTIONS OF EACH TAILGATE LIFT BY FOLLOWIN THE MAINTENANCE OPERATIONS AS SPECIFICALLY OUTLINED IN THE OWNER'S MANUAL PUBLISHED BY THE MANUFACTURER. THE APPROPRIATE PREVENTIVE MAINTENANCE INSPECTION PROCEDURES SHALL BE ADHERED TO, TO DETERMINE UNSAFE CONDITIONS, SUCH AS, BUT NOT LIMITED TO, THE FRAYING OF ANY OF THE LIFTING CABLES. ALL DEFICIENCIES NOTED MUST BE RECORDED AND CORRECTIVE ACTION TAKEN.
