Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likley to cause death or serious physical harm to employees in that employees were exposed to: THE HAZARD OF FALLING FROM A LADDER THAT WAS PLACED IN A LOCATION WHERE IT COULD BE DISPLACED BY MOVING VEHICLES. THE LADDER WAS PLACED IN THE MIDDLE OF THE SMALL ALLEY NEXT TO THE COLONIAL BLOCK BUILDINGS WHERE CARS AND TRUCKS PASS BY. THERE WERE NO BARRICADES OR WARNING SIGNALS AROUND THE LADDER TO WARN THE VEHICLE OPERATORS ABOUT THE WORK BEING DONE AND TO PROTECT THE WORKER ON THE LADDER. ONE FEASIBLE METHOD TO CORRECT THIS HAZARD IS TO PROVIDE TRAFFIC CONES OR SOME OTHER TYPE OF SIGNS OR BARRIERS THAT WOULD WARN VEHICLE OPERATORS OF THE LADDER AND DIRECT THEM AWAY FROM THE POTENTIAL HAZARD AREA.
