Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: a) Employees in the shop of the number 2 machine and muller, were exposed to machinery that inadvertently could be started while maintenance work was still being performed. Electrical safety clearance was not achieved by taking measures to ensure that equipment was de-energized and by reinforcing those measures with formed safeguards against altering that de-energized status for as long as clearance was required. A feasible and useful method to correct the hazard, among other methods, is to de-energize the electrical power circuit; and also training and supervision of employees working on industrial electrical equipment with a formal, printed policy clearance system.
