Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The
employer did not furnish employment and a place of employment which were
free from recognized hazards that were causing or likely to cause death
or serious physical harm to employees in that employees were exposed to:
On or about November 6, 1987
a) The potential hazard of an electrical arc causing the rupture or
puncture of a boiler tube containing super heated steam and the
resulting jet striking one or more employees. At the Astoria Plant,
21st Street and 20th Avenue Astoria, N.Y. because of the failure to
assure the boiler had been properly removed from service and was safe
to work on. Employer violated company implemented safety work rules
indicated in section IV, paragraph 4-70 of the "General Rules and
Procedures."
Among other methods, one feasible and accepted abatement method to
correct the hazard is:
1) To develop work permits in such manner as to assure all repair work
including the repair and replacement of insulation and skin casing,
as needed, be completed before the boielr burners are reignited.
