Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not furnish employment and a place of employment which were
free from recognized hazards that were causing or likely to cause death
or serious physical harm to employees in that employees were exposed to:
The hazard of asphyxiation from oxygen deficiency and/or toxic gases
while performing work inside oil storage tanks located at east and
west yard areas.
One feasible and acceptable method, among others to correct this hazard
is to provide tank entry procedures, as follows:
1- Written standard operating procedures for tank entry and dangerous
situations that could be encountered.
2- Initial and periodic training and re-training for all employees on
the standard operating procedures.
3- Use of equipment for the testing of oxygen deficient atmospheres,
and the measurable amounts of combustible gases.
4- Provide employes entering tanks with a life-belt, lanyard and
safety line.
5- Provide for a monitor or stand-by employee to be in attendance and
equipped to conduct a rescue operation.
6- Institute and enforce the use of a confined space entry permit
system.
7- Institute labeling and posting of confined space operation.
8- Prior and complete ventilation and evaluation of the atmosphere
inside tanks before entry.
