Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to crushing injuries from the operation of concrete mixer trucks numbers #20 and 4-74 in reverse gear without audible back-up alarms or signalmen indicating it was safe to back up. a) A feasible and useful means of correction would be to either equip the trucks with the appropriate alarms that could be easily heard by employees, or have the truck back up only after being signaled it was safe to do so, on or about November 30, 1989.
