Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The
employer did not furnish employment and a place of employment which were
free from recognized hazards that were causing or likely to cause death
or serious physical harm to employees in that employees were exposed to:
a) General Plant Complex; the facility has no emergency procedures
established pertaining to personnel instructions in any emergency
that may be anticipated. Additionally, the procedures should include
portable fire extinguishers and instructions on the types of fires in
which they may and may not be used, evacuation instructions if a fire
involves and is in danger of spreading to pyrotechnic mixtures and
prescribed procedures for alerting other employees.
A feasible and useful method to correct the hazard, among others, is to
formulate emergency procedures in fireworks plants and safety
requirements and procedures for handling explosives, pyrotechnics and
fireworks.

materials from the building.

a) Portable fire extinguishers were not provided for employee use in all
of the buildings throughout the general plant complex except those
buildings in which pyrotechnic mixtures are exposed. In addition to
fire extinguisher protection against Class A, B and C fire potential,
extinguishing agents for the protection of Class D hazards (aluminum
powder) were not provided where required.
A feasible and useful method to correct this hazard, among others, is to
provide and distribute fire extinguishers according to the class of fire
that could be expected to occur, areas required to be protected and the
compatibility of the hazards involved.
