Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard of being struck by a backhoe boom and/or bucket: a) Whitpain Shopping Center Construction Site - Employees operated a Case 580 Super E loader backhoe (P.I. #17033742) to place asphalt material along a newly installed curb. The loader bucket was used for this application. The backhoe attachment was not in the transport mode but was swung 90 degrees to the side. The backhoe attachment remained in this position when machine was being transported to the area it was to be parked, thus exposing employees to injury. Operation conducted on or about 8/4/92. Among other methods, one feasible and acceptable abatement method to abate this hazard is to position backhoe attachment in the transport position with bucket straight to rear as required in the operators manual.
