Section 5(a)(1) of the Occupational Safety and Health Act of 1970: the employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to being struck by falling load(s): On 11/7/91, a load of sprinkler pipe was being hoisted to the 31st floor of the C & S Bank Plaza Building located at 105 W. Whiting Street, Tampa, Florida 33602. The loose individual pieces of sprinkler pipe were loaded into a prefabricated open-ended steel basket and the basket and the pipes were hoisted by using two 20 foot nylon slings which were rigged in single choker hitches. While attempting to pull the load into the 31st floor of the building the basket containing the loose sprinkler pipe tilted in amanner that allowed the loose sprinkler pipes to slide out of the back of the open-ended basket which resulted in approximately 90of the suspended load falling 31 stories to the ground below. Among othe methods, one feasible and acceptable method to correct this hazard is to ensure that the load is secured and balanced in the sling(s) or hoisting device(s) before being hoisted.
