Section 5(A)(1) of the Occupational Safety and Health Act of 1970: the employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard of infection by blood borne pathogens when in the course of their work they come in contact with body fluids. These employees are not being trained concerning proper work practices to follow when said exposures occur. This item may be abated by ensuring all employees who are potentially exposed to blood borne pathogens are trained concerning proper work practices prior to any exposure.
