Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to crushing injuries due to six(6) unsafe overhead hoists in use: a) On or about 5/16/90, employees working in the finning area were exposed to six (6) unsafe Overhead Dayton, Jet, Yale and Coffing hoists being used; in that, running ropes were corroded, worn and kinked, the link chains were corroded and unclean, the throat opening on the hooks were deformed, and the braking mechanisms were not examined before use. Among other methods, one feasible and acceptable abatement method is to develop and maintain an adequate inspection procedure incorporating both frequent and periodic inspection guidelines for all the hoists in use.
