Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likey to cause death or serious physical harm to employees in that employees were exposed to: a) Repair department, east and west side- The employees working in the repair department were required to work under elevated loads on the hydraulic lifts, (numbers-1-3-4) with defective locking devices that did not hold the lifts in the fully extended position and three fully extended hydraulic lifts (numbers-2-5-6) with hydraulic fluid and air leaks, thereby exposing the employees to the hazards of being struck by a vehicle or caught between a vehicle and the floor if the automotive lift mechanically failed. A feasible method for correcting the hazard is to provide the automatic hydraulic lifts with a automatic mechanical locking device to hold the lift to the full extended position, such as that specified in ANSI B 153.1 Section 3.1.10 1974.
