Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to crushing injuries/lifting device failure due to a below the hook lifting device that was not marked with it's rated load capacity: a) 1201-13 W. Glenwood Avenue, Philadelphia, PA 19133 - the device used to lift the Bobcat from the ground to the 4th floor was not inspected and the rated load capacity was not marked on the device. Observed 02/07/94. ABATEMENT NOTE: A feasible abatement method would be to inspect all material lifting devices at least monthly and document the inspection results. Also, mark the safe rated load capacity on the lifting device.
