Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The
employer did not furnish employment and a place of employment which were
free from recognized hazards that were causing or likely to cause death
or serious physical harm to employees in that employees were exposed to:
a) The potential hazard of oxygen deficiency, toxic substances, or
combustible gases in a confined space. Employee(s) were cleaning
paint storage containers and the employer had not established a
confined space entry procedure.
Among other methods, one feasible and acceptable abatement method to
correct this hazard is:
1) Use mechanical ventilation to thoroughly ventilate the container
prior to entry and during the work being performed in the confined
space.
2) Have a standby employee designated to watch and be in constant
communication with the employee inside the confined space.
3) Use water to wipe out the inside of the container instead of
solvents.
