Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The
employer did not furnish employment and a place of employment which were
free from recognized hazards that were causing or likely to cause death
or serious physical harm to employees in that employees were exposed to
fall hazards when boarding or leaving the lighter barge and tugboats
they could not step safely to or from. There were no ramps, safe walkway
or other safe means of access provided:
a) Pier 2 - employees were permitted to board or disembark the tugs
James McAllister, Theresa McAllister, Patrick McAllister and Eric
McAllister without benefit of using safe boarding device.
Among other methods, one feasible and acceptable abatement method to
correct this hazard would be for the employer to provide a ramp, safe
walkway or other equivalent means ot be utilized by employees when they
cannot step safely to and from the pier or river tug boats.
