General-duty citation text
Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to falling into the effluent area or the river when accessing the rake platform or when raking the material out of the effluent area while standing on the rake platform. Among other methods, one feasible and acceptable abatement method to correct this hazard is the building of standard railings on the walls of the effluent area (both effluent and river sides) and on two sides of the platform (the rake side and river side). EFFLUENT AREA: WALLS ADJOINING EFFLUENT, PLATFORM AND RIVER SIDES LACKED RAILINGS TO PREVENT EMPLOYEES FROM FALLING EITHER INTO THE EFFLUENT AREA OR THE RIVER WHEN ACCESSING THE RAKE PLATFORM OR WHEN RAKING THE MATERIAL OUT OF THE EFFLUENT AREA WHILE STANDING ON THE RAKE PLATFORM.
