Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not furnish employment and a place of employment which were
free from recognized hazards that were causing or likely to cause death
or serious physical harm to employees in that:
a) Employees in the Leocast Batch Area were exposed to potential death
or serious injury that could occur from being struck by or crushed
by the pendant operated chain hoist ans cable hoist or the hoists
loads as a result of the following unsafe conditions or practices:
1) Pendant control buttons not functioning as intended.
2) Modification of the hoists without the manufacturer's approval.
3) Slack chain hanging from the hoist that could become entangled in
rotating parts of other machinery such as the mixer.
4) Loads passing over the heads of employees.
5) Loads left suspended in the air unattended.
6) Loads striking obstructions such as roof trusses.
7) Lack of lock out/tag out procedures during maintenance operations.
Among other methods, one useful and feasible method to correct these
hazards would be to establish and implement inspection, maintenance and
operator training programs in accordance with the manufacturers operator
manual. American National Standards Institute, ANSI B30.16-1973,
entitled Overhead Hoist, could serve as a useful guide in developing
such programs.
