Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not furnish employment and a place of employment which
were free from recognized hazards that were causing or likely to cause
death or serious physical harm to employees in that employees were
exposed to the hazard of a flash fire or explosion during the pumping,
removal and cleaning of underground storage tanks that contained
gasoline:
LOCATION:  Ponti Brothers, 2 Hope Street, Hoboken, NJ - Tank Removal;
A) Vacuum suctioning operation:  On 6/14/91 the chemical vacuum truck was
discharging gasoline vapor above and adjacent to the hot exhaust manifold o f
the vacuum motor (Reference - API-1604 - 2nd Edition-1987 Section 4.1.3 and
3.2.4).
B) Tank excavation and removal:  On 6/13/01 and 6/14/91, there was an
apparent lack of site control as evidenced by the fact that there were
several instances of people smoking cigarettes in the work area.  Also,
during this operation on 6/14/91 the fugitive gasoline vapors were vented a t
ground level and the gasoline tank was not monitored correctly to determine
the vapor concentration (Reference - API-1604 - 2nd Edition-1987 - Section
1.3.2.1 and Section 4.2.2.).
Among other methods, one feasible and acceptable abatement method
to correct this hazard is to follow the removal and disposal of used
underground petroleum storage tanks - API-1604 - 2nd Edition, Dec.
1987.  (NOTE:  See amendments dated 3/6/89).
