Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to a crushing hazard: a) Mill Creek Road - Employees were observed either riding in the front bucket of a 426 caterpillar SN7BC01242 or riding on the outside step while the front end loader/backhoe traveled up the street. This occurred six times between 8:30 a.m. and 9:03 a.m, on or about October 28, 1992. Employee's were about 2 1/2 to 3 feet above the roadway. Among other methods, one feasible and acceptable abatement method to correct this hazard would be to instruct the employee(s) not to ride in the bucket and enforce that instruction.
