Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not furnish employment and a place of employment which
were free from recognized hazards that were causing or likely to cause
death or serious physical harm to employees in that employees were
exposed to falling into an unshored trench:
a)  On or about March 25, 1993, employees were observed
climbing onto the koetring excavator bucket.  Employees
were then lowered into an unshored trench that was filling
up with storm drain water.  Employees were observed working
in the trench while standing on the up turned bucket.
Among other methods, one feasible and acceptable abatement method
to correct this hazard is to implement a trench entry procedure which
includes, but is not limited to:
1.  Properly trained employees and enforce the use of ladders in
trenches.
2.  Instruct excavation equipment operators in the safe operation
of the equipment and enforce that policy.
