Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to a fall hazard of up to 18 feet: a) Distribution Center, Yale "cherry picker" (high lift order picker rider truck) - The operator platform was not guarded with standard guardrail or safety belt and lanyard while operating controls at an elevated position, on or about December 5, 1991. Among other methods, one feasible and acceptable abatement method to correct this hazard is to provide restraining means such as rails, chains, or a body belt with lanyard or deceleration device to be worn by the operator.
