Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The
employer did not furnish employment and a place of employment which were
free from recognized hazards that were causing or likely to cause death
or serious physical harm to employees in that employees were exposed to
multiple fractures due to fall hazard from modified work platform:
A) Penn Color Renovation Project, Hatfield, PA. -
Employees were using a Condor "Chick" (model 2548) articulating
aerial work platform to install metal studs and 4'x12' panels
of drywall. The platform of the machine was modified by screwing
two 2x12 planks to work platform for employees to extend its
reach. No manufacturers certification accompanied this modification.
Among other methods one feasible and acceptable abatement method to
correct this hazard is to obtain a manufacturer certification on any
modification made to the work platform or use an alternative method of
elevating employees.
