Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The
employer did not furnish employment and a place of employment which were
free from recognized hazards that were causing or likely to cause death
or serious physical harm to employees in that employees were exposed to
a twelve foot fall hazard:
A) Warehouse - The employer places a wood pallet on the forks of a
forklift. The platform was not secured, the railing was only 28
inches and the platform was not slip resistant.
Among other methods, one feasible and acceptable abatement method is to
build a platform that has standard railing 42 inches high with a midrail
at 21 inches attached to the platform to the forks and make the floor
slip resistant.
