Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to potential hazards of fires and/or explosions due to dust collection systems not being designed, constructed, and maintained according to established safety and health standards: a. Plant - Employees working in areas served by the dust collection system were exposed to fires and/or explosions due to dust collection systems not being designed, constructed, and maintained according to established safety and health standards. ABATEMENT NOTE: Among other methods, one feasible and acceptable abatement method to correct this hazard is to design, construct, and maintain the dust collection system according to established safety and health standards. See NFPA 654 Standard for the Prevention of Fire and Dust Explosions in the Chemical, Dye, Pharmaceutical and Plastics Industries.
